Your Massachusetts Personal Injury Claim
In Massachusetts, as in other states, every person has a duty of reasonable care to those who might be affected by their conduct. In the context of drivers, this means a duty to pay attention to the road and obey rules of traffic. For property owners, this duty entails taking reasonable steps to ensure that one’s property is safe from dangerous conditions, such as slippery floors, broken stairs, and vicious or poisonous animals. Similarly, manufacturers of products have a duty to see that their products are safe for consumption and use.
Failure of drivers, property owners, manufacturers, or anyone else to abide by this duty of care can result in civil liability for any injuries they cause to others. To establish a personal injury claim based on negligence in Massachusetts, a plaintiff must prove:
- The defendant owed a duty to the plaintiff
- The defendant breached that duty
- The breach was the actual and legal (“proximate”) cause of injury
- The plaintiff actually suffered injury

A plaintiff who has successfully proved these four elements can recover economic damages (including medical bills, lost wages, and property damage) and non-economic damages (such as pain and suffering). However, under Massachusetts General Laws Chapter 231 Section 6D, the availability of damages for pain and suffering requires that the economic damages for medical and related exceed $2,000, except in cases involving death, dismemberment, or serious disfigurement.
