Lawyers Weekly, August 24, 2009 - Boys crushed by gate while playing at
school; Older brother dies, younger badly hurt.
On Labor Day in 2007, an 11-year-old boy and his 8-year-old brother
were playing on the grounds of the grammar school they attended, which
was a short walk from their home. Located on the open grounds of the
school was a large, three-sided brick structure, designed as a storage
enclosure for two trash dumpsters. A 1,600-pound steel gate, which at
one time guarded the entrance to the dumpster enclosure, had been
removed several years earlier to provide easier access for sanitation
trucks. After being removed, the steel gate apparently had been placed
in a leaning position against one of the interior walls of the
enclosure and was not otherwise secured. Click

Parker Scheer Secures $255,000 Dog Bite Settlement. On June 16th, 2006, the plaintiff was a lawful
visitor at the defendants’ home. The defendants were the owners of an
American Bulldog named “Buster”. The plaintiff, a neighbor of the
defendant, was familiar with Buster. As the dog approached the
plaintiff, the plaintiff knelt-down and the dog suddenly bit at the
plaintiff’s face, severing a portion of the plaintiff’s left nostril
and upper lip. There was no evidence of teasing or tormenting which
would otherwise have served as a defense to the plaintiffs’ statutory

written decision dated June 20th 2008, The United States Court of
Appeals for the First Circuit reversed the earlier decision of a United
States District Court Judge, which dismissed an architectural firm’s
claims for copyright infringement on the basis of timeliness. Garrett
J. Lee, a Senior Associate with Parker Scheer LLP’s Boston office,
representing the architectural firm, successfully argued the appeal
before the three judge panel in Boston. The panel included former

Two MBTA Green Line Trolley Cars Collide in Waban, Massachusetts.
Numerous injuries reported.
According to published reports, the train crash occurred at
approximately 6:00 PM Wednesday evening, May 28th, 2008 near Dorset
Road in the Waban section of Newton, Massachusetts while the trains
were on route to Woodland Station. Because the crash occurred during
rush hour, the cars were packed with commuters. At least one victim was
reportedly Medflighted to Boston for emergency medical treatment.

The plaintiff, a 32 year old male, was operating his motorcycle along
Route 16 (Washington Street) in Sherborn, Massachusetts when the
traffic in front of him began to slow. In response, plaintiff slowed
his motorcycle and was almost at a complete stop when he was struck
from behind by a sport utility vehicle, operated by the defendant. Upon
impact, the plaintiff was thrown forward into the air before falling to

Injury: Supreme Court Hands Down a Major Victory For Victims of Bad
Drug Labeling.
In one of the most closely watched cases by personal injury trial
lawyers, The U.S. Supreme Court, in 6-3 decision, upheld a six million
dollar jury award to a woman who suffered the loss of her arm due to
poor drug labeling by the pharmaceutical giant, Wyeth. In the 80 page
decision in the case of Wyeth v. Levine, The Court ruled that Wyeth,
makers of the drug known as Phenergan, was liable to the plaintiff who
suffered the loss of her arm after the drug was accidentally injected
into her artery rather than the intended vein during a procedure known
as "I.V. Push". The plaintiff had argued at trial that the drug's
labeling materials failed to provide stricter warnings to the
plaintiff's physicians against the use of the I.V. Push method when
administering Phenergan due to the relatively high risk of gangrene. Read

Every year in Massachusetts hundreds of cars are reported stolen. Many
of these thefts occurred because the vehicle owner left the keys to the

Injury: Owning a Dog Could Get a "bit" Riskier
Insurance companies that insure Massachusetts homeowners have quietly
been reducing, if not altogether eliminating insurance coverage
previously available to dog owners. The trend began several years ago
when a number of homeowner's insurance companies began "black-listing"
certain breeds they labeled as "highly dangerous", including Pit Bulls,
Doberman Pinschers, American Bull Dogs, and other breeds believed to be
more dangerous to humans than other breeds. More recently, however,
owners of breeds not listed as "dangerous" have discovered that their
homeowners' insurance policies provided a substantially lower limit of
coverage for claims asserted against them when their dog did cause
injury. Unfortunately, discovering low (or no) limits of coverage after

year old woman as she waited to board the bus. Two police officers and
several other persons were also reportedly treated for injuries. Fung
