In the state of Massachusetts, the drug laws, statutes, fines and punishments are complex. The types of drugs are broken down in categories or “classes.” For example, marijuana is considered a Class D substance. If convicted, the length of prison time and the amount of the fine depends on the class and the amount of the substance. With marijuana, for instance, if a person is caught trafficking 50 pounds or more but less than 100 pounds, s/he may face a state prison sentence of two to 15 years and a fine of $500 up to $10,000. That is why it is imperative for a person to contact an experienced lawyer who will help her/him navigate the law.
If a person is facing a 258E Harassment Prevention Order, it could mean that the person has committed three or more acts that were: 1) malicious and willful toward the plaintiff 2) aimed at the plaintiff 3) intended to cause the plaintiff fear, intimidation, abuse or property damage. If a judge grants the restraining order, the person must not have contact with the plaintiff and may even have to pay restitution for direct losses to the plaintiff. Under Massachusetts law, Chapter 209A: Abuse Prevention, proceedings may be followed that include: an order for a suspension and surrender of firearms, a domestic violence record search and recommendation to a certified batters’ treatment program as a term of probation.
Attorney Tofani has worked extensively with those who have restraining orders taken out on them. This type of legal order is a specialty of his, and therefore, he has received many successful outcomes in these cases.

Therefore, he believes in nonjudgement and recognizes that veterans are heroes who have fought courageously and selflessly for the rights and freedoms of every American.
The VALOR Act
In 2012, Governor Deval Patrick signed into law Senate Bill 2254—known as the VALOR Act. It grants the district courts and the Boston Municipal Courts the power to divert certain servicemen and veterans to treatment programs rather than prosecute them as alleged criminals. The act empowers veterans who are facing charges an opportunity to change their lives through a process of accountability, treatment and structure. Not all veterans qualify, but for those who do, it could be a positive life-changing experience that leads to sobriety and wellness, both mentally and physically. If a veteran qualifies, s/he will go through this process in Veterans Treatment Court.
Attorney Tofani has been honored to defend his veteran clients in Veterans Treatment Court in Boston. He utilizes the strong relationships with US Veterans Outreach Liaisons and has collaborated with the US Department of Veterans Affairs to achieve positive results on behalf of veterans. The results are including but not limited to: Dismissals, as well as Pretrial Diversion in lieu of criminal prosecution.
