Parker Scheer Managing Partner, Susan Bourque, was quoted in an article about whether more safeguards are needed to cap runaway punitive damage awards following a $1 billion verdict against Philip Morris USA, Inc. Since the award was eventually reduced to $56 million after both sides suggested it was too high, Bourque argues that “the guardrails are in place and the guardrails worked here. I don’t think this is a great test case.”
The Massachusetts Supreme Judicial Court is set to hear arguments on November 5, 2025.
