CASE SUMMARY:
Our car accident lawyers handled a case where the plaintiff was a car operator traveling North on Lynn Street in Malden, Massachusetts. At the same time, a second car, operated by the defendant, was traveling South on Lynn Street. As the defendant rounded a curve in the road, the defendant lost control of his car, crossing over into the plaintiff’s lane of travel and striking the plaintiff’s vehicle head-on. As a direct result of the impact, the plaintiff suffered multiple injuries including fractures to his left maxillary sinuses; a fractured left nasal plate; a left frontal skull fracture; a fractured left orbit; facial lacerations; and displaced fracture of his right distal talus. The plaintiff was employed as a physical education teacher and was the father of a three-year-old girl.
At the time of the accident, the defendant was operating a car without a valid motor vehicle operator’s license and was in the process of making a bank deposit for two local gas stations. The plaintiff sought coverage, based on agency theories, under the gas stations’ corporate liability policies.
The case was settled following two days of mediation.
