The decedent suffered a fatal heart attack three months after
he saw his primary care physician for chest pain running down
into his left arm, which was improperly diagnosed as residual
soreness from a prior bow-hunting trip.
The standard of care requires the doctor, while justified in
considering bow hunting as a possible explanation for the patient’s
chest pain, to consider and treat the possibility that the chest
pain was caused by heart disease, a far more serious condition.
Moreover, the decedent’s personal information – including
his smoking habit, his family’s history of heart disease,
a genetic circulatory disorder, chronic shortness of breath, and
his recent job-related stress – made him a strong candidate
for heart disease and heart attack, yet the significance of these
factors was not sufficiently appreciated by the doctor. Finally,
the doctor’s misinterpretation of medical tests, such as
an ECG e exhibiting likely indicators of heart disease; his failure
to examine adequately the existent medical records and order testing;
and his unresponsiveness to the decedent’s subsequent complaints
of chest pain further illustrate his breach of the standard of
care. These and other fundamental mistakes made by the defendant
were central factors contributing to this tragic, early, and preventable
death.
Because the doctor failed to act in accordance with accepted
standards of care, the doctor and his employer are responsible
for the decedent’s death and resulting losses to his estate.
The decedent’s wife also suffered significant emotional
damages for which she had the right to collect. She was entitled,
furthermore, to compensation for her husband’s wrongful
death under RSA 556:12, including his consortium, loss of income,
loss of life, and loss of enjoyment of life in future years.
