This claim was brought against the defendant property owner by
a woman who was shopping in North Conway, New Hampshire while
on vacation. She walked toward a store where the sidewalk approaching
the building joined that which surrounded the store. Where the
walkways connected, a raised joint caught the sole of her sandal,
causing her to trip and fall forward. Her body, arm, and face
slammed into the corner of the building as she fell down onto
the cement walkway, thereby fracturing three bones in her elbow
(an injury that will never fully heal), damaging her false teeth
and jewelry, and necessitating prolonged and costly medical treatment.
The defendants were responsible for the plaintiff’s injuries
because under New Hampshire law, the owner of a property owes
a “non-delegable” duty to “business invitees”
to use reasonable care to make sure the customers are not exposed
to unreasonable and unnecessary dangers while on their property.
Furthermore, the plaintiff’s fall occurred on a walkway
which had been designated by the defendants as a handicap access
route to the building. In order to qualify for a “handicap”
designation, an area must conform to federal regulations as well
as building and safety codes. The walkway in question did not
fulfill these standards, which require that slopes be used to
smooth out height differences and that vertical surfaces in sidewalks,
such as the raised slab on which the plaintiff tripped, not exceed
1/4 inch. In fact, the actual height of the vertical rise was
twice that – a full 1/2 inch.
