Nature of Case: Leg amputation and nerve injury
caused by driver falling asleep and striking two motorcyclists.

This case was brought against both the defendant driver of the
car and the company for which he was working at the time of the
accident.
The motorcyclists were driving east on Route 4 in Epsom, New Hampshire.
Driving west was the defendant, who was returning to Vermont from
a company trip to Portsmouth, New Hampshire. The defendant, who
had little sleep over the past 24 hours, fell asleep behind the
wheel of the car, crossed into the opposite lane, and struck the
plaintiffs’ motorcycles.
Injuries sustained by one of the plaintiffs included multiple
fractures, nerve damage, tissue and blood infection, liver laceration,
contusion of the heart and lungs, extensive blood loss, and eventually
lower-leg amputation. This victim endured a hospitalization period
of 63 days. The other victim suffered fractures to the right wrist,
tibia, and fibula, as well as a left femoral fracture, left foot
drop, and left ankle fracture.
The primary challenge for the plaintiff's attorneys in the case
was to prove that the defendant car driver was an employee –
not merely an independent contractor – of the well-insured
company for which he worked. Proving the employment issue required
a 5 day jury trial. After the employment issue was decided in
plaintiffs’ favor, the case settled for a total of $2 million.
