This victim endured a hospitalization period of 63 days. The other victim suffered fractures to the right wrist, tibia, and fibula, as well as a left femoral fracture, left foot drop, and left ankle fracture. The primary challenge for the plaintiff's attorneys in the case was to prove that the defendant car driver was an employee – not merely an independent contractor – of the well-insured company for which he worked. Proving the employment issue required a 5 day jury trial. After the employment issue was decided in plaintiffs’ favor, the case settled for a total of $2 million.
