Las Vegas is of course known for the many hotels and casinos that populate the city and bring in hundreds of thousands of tourists every year. People flock to this city in the desert looking for a fun and relaxing vacation, filled shows and trips to the casinos, fine dinning and shopping. What most people never expect is the possibility of an accident, or worse, occurring at one of these hotels or casinos.

There are two main types of falls:

Proving a slip and fall case can sometimes be difficult. The plaintiff must prove that their accident was caused by a "dangerous condition," and that the owner of the property was aware of that dangerous condition. Dangerous conditions must present an unreasonable risk to a person on the property and it must have been a condition that the plaintiff did not anticipate. This statement implies that one must be aware of and avoid obvious dangers.

In order to prove that a property owner knew of a dangerous condition, the plaintiff must show that:

  • The owner created the dangerous condition;
  • The owner knew the condition existed and neglected to correct it; or
  • The dangerous condition existed for such a length of time that the owner should have discovered and corrected it.

The owner of a commercial property such as a store, restaurant, hotel or casino can be considered legally responsible…..

  • The owner or employee must have caused the hazardous conditions;
  • The owner or employee must have knows of the dangerous surface but did nothing to correct it;
  • The owner or employee should have known of the dangerous surface because a "reasonable" person would have discovered and corrected it.

The third situation is perhaps the most common, but also less clear-cut because of the phrase "should have known." Liability in these cases is decided by common sense. The law determines whether the owner of the property was careful by deciding if the steps taken to care for the property were reasonable.
