SUMMARY:

Plaintiff was visiting Las Vegas to attend a snowboard and ski convention. He was at a nightclub with some friends when a fight broke out 20 yards away. He backed away from the altercation with his friends when he was struck in the eye with a glass cocktail glass. The glass shattered and he was rushed to the hospital for emergency surgery. He suffered a detached retina. His appearance was changed to look as if he had pink eye. Plaintiff also had received permanent vision problems as a result of the incident.

Plaintiff sued the nightclub and alleged that the nightclub was negligent in not providing a safe environment for its patrons. Plaintiff produced evidence of numerous glass throwing incidents in the same club.

The nightclub engaged in discovery abuse throughout the litigation. Eventually, the judge struck the nightclub’s answer on plaintiff’s motion. The case settled shortly thereafter for $2.75 million.
