CASE SUMMARY:
Plaintiff had just dropped off her child at a retail center parking lot. She was driving through the parking lot when another vehicle that was driving at a moderate speed caused a T-Bone collision. There were no stop signs in the area. The SUV that the plaintiff was driving tipped over and smashed plaintiff’s hand between the pavement and the parking lot. Plaintiff suffered multiple breaks and fractures in her hand together with several torn ligaments. Plaintiff required extensive physical therapy and permanent scarring.
Plaintiff sued the manufacturer and dealer of the vehicle, the driver of the other car, and the retail parking lot owner. Plaintiff produced evidence of several other accidents in the same area as that where Plaintiff was injured. Plaintiff likewise discovered a pattern of tipping over in the same model of SUV manufactured by defendant.
