While insurance companies and doctors’ organizations have oft claimed that rising costs of medical malpractice insurance is a result of frivolous lawsuits, there is little truth to these statements.  Another Harvard study found that while only 1 in 8 victims of medical malpractice ever files a claim, only 1 in 16 ever receives compensation for their injuries due to doctor’s negligence.  The problem therefore, seems to be not that there are too many unwarranted lawsuits, but too few victims with proper representation.
