CASE SUMMARY:

Plaintiff and her husband were married for approximately forty (40) years. They were enjoying their golden years together surrounded by friends and family. Plaintiff’s husband, 78, was retired but had to work a part time job at a local grocery store to help pay out with the bills.

Plaintiff’s husband was returning home from work when, after waiting for the intersection to clear, made a left turn at an intersection. The light was green when he entered the intersection but he had to wait for the light to cycle through and the intersection to clear before he made his turn, As he made his turn, Defendant zoomed through the intersection and caused a collision after the light had turned red.

Defendant vigorously defended this case and never made an offer to settle during the pre-trial proceedings. Defendant claimed that he had the right of way and blamed plaintiff’s husband for the accident. After years of litigation, the case went to a jury trial before the Honorable Lee Gates. The parties used extensive media to assist in the presentation of the case. After a week-long trial, the jury found for the Plaintiff and awarded $1,000,000. The parties settled prior to appeal for $1,100,000.00.
