On January 28, 2002, the plaintiff was working as a siding installer when he fell approximately 12 feet from an icy bed ladder. He was rendered unconscious by the fall and rushed to the Brigham & Women’s Hospital where he was admitted for 6 weeks. He was treated at Braintree Rehabilitation Hospital where he underwent a long course of cognitive and physical therapy.
At the time of the incident, the plaintiff earned approximately $ 850.00 per week. He was awarded Social Security Disability benefits in addition to his settlement. Furthermore, the employee’s attorney negotiated an arrangement whereby the employee’s wife is paid more than $ 85,000.00 per year to provide assisted care for her husband who is able to walk and provide for his own basic personal needs, but does require supervision due to behavioral difficulties associated with his head injury.
