The plaintiff was a successful cosmetics executive whose car was struck after she pulled into the breakdown lane on I-93 in Danvers to talk a cell phone call from a customer.

The plaintiff was stabilized at Union Hospital and then airlifted to Massachusetts General Hospital where she underwent surgery to address her multiple fractures and internal injuries.

Following her discharge from MGH, the plaintiff underwent an intensive course of physical therapy which addressed the impairments associated with her physical injuries. She also underwent a prolonged and difficult course of speech and cognitive rehabilitation which allows her to function, but at a significantly decreased level than prior to the accident.

She was awarded Social Security Disability benefits after a hearing at the Office of Hearings and Appeals. She also had a private disability policy which provides her with a source of income and allowed her to settle her workers’ compensation claim.

The claims against the driver of the vehicle responsible for the accident and the plaintiff’s underinsurance claim were resolved by referring counsel, and netted the injured employee a considerable recovery.
