The Massachusetts Workers’ Compensation Act provides benefits for the payment of medical expenses incurred to treat injured workers’ work related injuries. While apparent that this may include suturing of a large cut, the casting of a fracture’ the Act is not as restrictive as one might think.

Less apparent are injuries, which may occur as an injured employee seeks to have injuries treated. A worker who is injured while traveling to a medical appointment for the treatment of a work related injury is entitled to have the workers’ compensation insurer pay for medical expenses associated with any injuries suffered while seeking treatment. Additionally, if the disability is worsened by such an accident, the employee is entitled to payment of weekly compensation benefits. In other words, if an injured worker is injured while traveling to a medical appointment for his compensable work related injury, any injury suffered during that trip is considered to be compensable under the Workers’ Compensation Act.

If a worker is injured during medical treatment, then the effects of those injuries are also considered to be compensable under the Massachusetts Workers’ Compensation Act. This may occur in many different contexts. Surgeries may not be successful, and more harm than good may result. Adverse reaction to medication is another example of how medical treatment can lead to further, and in some cases, devastating consequences. If the underlying need for treatment is a work related injury, then these consequences are covered by workers’ compensation.

It is also not unusual for injured workers to suffer additional injuries as a result of the underlying work related condition. If one has had a knee injury, often times he or she may be prone to have the knee buckle, and cause a fall. If that injured employee suffers a new injury as a result of such a fall, then likewise it is compensable. If a person with a head injury suffers from dizziness, and falls while walking down stairs at home, the resulting injuries are also compensation under Massachusetts workers’ compensation.

Injured workers are also entitled to be reimbursed for mileage traveled to have their injuries treated. Parking is also reimbursable. A record of each trip should be made along with the mileage traveled. Periodically a request for reimbursement to the insurer should be made.
