The plaintiff, a 41 year old hospital secretary, suffered Reactive Airway Disease Syndrome (R.A.D.S.) after she was exposed to pesticides applied overnight at the hospital. The plaintiff was prepared to offer evidence at trial that on September 14, 1996, the defendant pesticide application company, applied a concentrated pesticide formula to the area where the plaintiff worked, in order to treat complaints of silverfish. According to the evidence, the defendant exterminator visited the hospital in the late evening hours and applied the pesticide material without sufficient notification to the hospital, its employees, or security staff. When the plaintiff and her co-workers arrived for work the following morning, they were confronted by a strong chemical odor. As a direct result of exposure to the chemicals applied by the defendant exterminator, the plaintiff suffered a painful and serious inflammation of her lungs, requiring medical treatment. The case settled after one day of mediation.
